Keep It in the Family: A Guide to Resolving Couple Disputes

The prospect of separating from a partner or spouse can be incredibly upsetting and daunting, especially when the costs of court proceedings are so well publicised. Fortunately, however, there are a number of ways to resolve couple disputes outside of the courtroom. In fact, formal legal action should always be considered a last resort when other dispute resolution methods have missed the mark. 


So, what are the most common options for couple dispute resolution?


Couples Therapy

If you’re still unsure whether your relationship is at an end, a counsellor or therapist might be able to assist you in addressing underlying issues. Through this process, you might realise that you want to reconcile with your partner and no longer require legal assistance. Remember, divorce or partnership dissolution is a “means to an end” that should only be pursued if your true intention is to bring your relationship to a complete end. 


The “Kitchen Table” Method

If your relationship has irreparably broken down, you and your partner might choose to negotiate your own agreement for finances or any child arrangements “over the kitchen table”. If you do feel able to have an amicable conversation, it’s still wise to pursue legal guidance so that you understand your options and what outcomes are most realistic. 


Mediation

If working out an agreement amongst yourselves isn’t feasible, mediation can be useful. This is the process by which a trained mediator helps you to reach a resolution in a neutral setting. Once again, it’s important to take legal advice independently from your partner to ensure that the legal ramifications of any agreement reached in mediation are suited to your circumstances. Legal advice can be provided in advance of the mediation and throughout the process. 


Negotiation

If discussing the matter with your spouse is not working, you could also ask a civil litigation lawyer to help negotiate a settlement on your behalf. Negotiations typically take place through telephone communication or face-to-face meetings. 


Court Proceedings

While court proceedings should be a last resort, in certain circumstances they are the most suitable option. It is currently in the news that the Government wants to extend support for family mediation offering funding to couples for that purpose. Mediation can assist. The purpose, it is said, is that it takes a family dispute at an early stage away from solicitors so that rowing parties cannot hide behind that symbolic barrier. However, the burden of mediation is that both parties need to come to it open-minded and prepared the negotiate. The benefit is reaching an early agreed conclusion without resorting to legal proceedings and the inevitable costs arising. There are circumstances quite often when mediation is not appropriate and that is where one party is vulnerable, either by reason of coercion or abusive behaviour on the part of the other, and it is not always the husband that is guilty of that. There needs to be equality of arms, so both parties are able to put forward their position freely and openly. Mediation is confidential and it is designed to encourage parties to speak up. Another occasion when the parties probably cannot agree to mediation proceeding is when they are either so far apart as to what they want to achieve or one of the parties declines to properly disclose their financial status in a financial dispute. There can be no question of having an open, full and frank discussion about matrimonial finances if the husband or wife is hiding capital or income from the other. Mr Evans offers a free half hour interview to assess any case as to the appropriateness of mediation for the reasons given above. That also encourages the potential client to develop a professional relationship with a legal adviser so they can be confident they can work together to promote an early settlement outside mediation if that be the case.

Cyber attacks and money laundering scams and various attempts to hack into Solicitors and other business account is nowadays at a high level and Almy and Thomas have stringent requirements in respect AML enquiries. We do need to see clients face-to-face with ID documentation which includes photo I.D and a recent utility bill, we do undertake a third party enquiry through search engines that we have to verify I.D. We have rules as to what cash sums we will receive from clients and we have procedures to consider conflict of interest checks in respect of one client as against the other. We will not accept bank funds other than from reputable facilities such as main clearing banks and we will not conduct transactions which involve monies coming from at risk countries in Europe and beyond. All these safety checks are to the benefit of our clients and ourselves and to date we have not had any problems in respect of AML enquiries. We do recommend clients be live to scams of which we are all aware and indeed it is ironic to note that the Solicitors Regulatory Authority (SRA) have posted details of scam individuals approaching solicitors purporting to be the SRA.
