"Lawyer Free" RTA Claims

The Ministry of Justice are proposing a system whereby claims for damages in respect of some types of injury in road traffic accidents which have a value of £5,000 or less are to be dealt with without the benefit of legal advice through the Small Claims Court.
Medical evidence will be obtained on behalf of the Claimant and the claim will be valued without the benefit of independent advice.
Almy & Thomas are monitoring the development of this proposal which is likely to go live in certain areas from 2019. We cannot see how Claimants will get a fair deal if effectively the claims are “managed” by a third party not acting for the Claimant or indeed in the best interests of the Claimant.
