The Ministry of Justice are proposing a system whereby claims for damages in respect of some types of injury in road traffic accidents which have a value of £5,000 or less are to be dealt with without the benefit of legal advice through the Small Claims Court.

Medical evidence will be obtained on behalf of the Claimant and the claim will be valued without the benefit of independent advice.

We cannot see how Claimants will get a fair deal if effectively the claims are “managed” by a third party not acting for the Claimant or indeed in the best interests of the Claimant.
